1.Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of the website located at www.shopcuriowonder.com and any related pages, content, features, and services (together, the "Site"), operated by Mid-Atlantic Retail Ventures, LLC, doing business as Curio Wonder ("Curio Wonder," "we," "us," or "our").
By accessing or using the Site, signing up for our notification or email list, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site.
2.About This Site (Pre-Launch Notice)
Our online store is launching soon. At present, the Site may operate as a "coming soon" placeholder where you can learn about Curio Wonder and join our list to be notified when we open. Sections of these Terms that refer to products, orders, payment, and shipping apply once our store is live and you are able to make purchases. The general terms — including those covering acceptable use, intellectual property, disclaimers, and limitation of liability — apply to your use of the Site now and going forward.
3.Eligibility
The Site is intended for users who are at least 18 years old, or the age of majority in their jurisdiction. By using the Site or placing an order, you represent that you are of legal age to form a binding contract and that the information you provide is accurate. Minors may use the Site only with the involvement and consent of a parent or legal guardian who agrees to these Terms.
4.Accounts
When account features become available, you may need to create an account to make purchases or access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5.Products, Descriptions, and Availability
We sell products such as DIY miniature kits, book nooks, 3D puzzles, mechanical model kits, and related items. We work to describe and display our products accurately, but we do not warrant that descriptions, images, colors, pricing, or other content are complete, current, or error-free. Product colors and finishes may vary due to photography and display settings. All products are subject to availability, and we may limit quantities, discontinue items, or change our offerings at any time without notice.
6.Pricing and Errors
All prices are listed in U.S. dollars and are subject to change without notice. While we make every effort to ensure pricing is accurate, errors may occur. If we discover an error in the price of an item you have ordered, we will notify you and give you the option to confirm your order at the correct price or cancel it. We reserve the right to correct any errors and to refuse or cancel any order containing a pricing or description error, even after an order has been submitted or confirmed.
7.Orders and Acceptance
Your submission of an order is an offer to purchase. All orders are subject to our acceptance, and we may refuse, limit, or cancel any order for any lawful reason — including suspected fraud, ordering errors, product unavailability, or limits on quantities. A confirmation email acknowledges that we received your order; it does not guarantee acceptance. A contract of sale is formed only when we ship the product to you.
8.Payment
By providing a payment method, you represent that you are authorized to use it and you authorize us (and our payment processor) to charge the full order amount, including taxes and shipping. Payments are processed by trusted third-party providers (for example, our e-commerce and payment platform), and your use of those services may be subject to their terms. We do not store full payment card details on our own servers.
9.Shipping and Delivery
We currently ship within the continental United States. Estimated delivery times are provided for convenience and are not guaranteed. Title and risk of loss for products pass to you upon our delivery of the items to the carrier. We are not responsible for delays caused by carriers, customs, weather, or other circumstances beyond our reasonable control. Shipping costs, methods, and estimated timeframes will be shown at checkout once the store is live.
10.Returns, Refunds, and Cancellations
Once our store launches, eligible items may be returned within [INSERT RETURN WINDOW, e.g., 30] days of delivery, provided they are unused, in original condition, and in their original packaging, unless otherwise noted. 12.Intellectual Property
The Site and its contents — including the Curio Wonder and Mid-Atlantic Retail Ventures names, logos, text, graphics, images, page layouts, and design — are owned by or licensed to us and are protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, scrape, frame, or create derivative works from any part of the Site without our prior written permission.
13.Acceptable Use
You agree not to use the Site to: violate any law or regulation; infringe the rights of others; transmit harmful code, spam, or fraudulent content; attempt to gain unauthorized access to the Site, accounts, or our systems; interfere with the Site's operation or security; or use automated tools to scrape or harvest data. We may investigate and take appropriate action, including restricting access, against anyone who violates these Terms.
14.User Content and Reviews
If you submit reviews, comments, photos, or other content to us or through the Site, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt that content in connection with our business. The Site and all products and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
17.Limitation of Liability
To the fullest extent permitted by law, Curio Wonder and Mid-Atlantic Retail Ventures, LLC, and their owners, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or any products purchased. Our total liability for any claim arising out of or relating to these Terms or the Site will not exceed the amount you paid to us for the product or service giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
18.Indemnification
You agree to indemnify and hold harmless Curio Wonder and Mid-Atlantic Retail Ventures, LLC, and its owners, employees, and agents, from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
19.Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us and attempt to resolve the dispute informally in good faith. If we cannot resolve it within a reasonable time, you agree that any dispute will be brought exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking relief in small-claims court where available.
20.Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above, and the updated Terms take effect when posted. Your continued use of the Site after changes are posted means you accept the revised Terms. We encourage you to review this page periodically.
21.General
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, make up the entire agreement between you and us regarding your use of the Site.
